READ CAREFULLY – THIS AFFECTS YOUR LEGAL RIGHTS

In return for the use of property, facilities and services (“facilities”) of Big Timber Waterslide,

I AGREE TO:

1. OBSERVE AND OBEY all posted rules and warnings.

2. ASSUME ALL RISKS arising from my use of or presence upon the facilities. I understand there is risk of injury in using the following activities and rides: waterslides, Tadpole pool, and other attractions. I also recognize there is a risk of injury from negligent, reckless or intentional acts of third parties in using the facilities and I assume this risk.

3. RELEASE Big Timber Waterslide and waive any claim for injury or damage arising out of my use of or presence upon the facilities, whether caused by the fault of myself, Big Timber Waterslide, or third parties.

4. INDEMNIFY AND DEFEND Big Timber Waterslide against all claims, causes of action, damages, judgements, costs or expenses, including attorney’s fees, which in any way arise from my use of or presence upon the facilities.

5. PAY for all damages to the facilities caused by my negligent, reckless, or willful actions.

The undersigned, as parent or guardian of the minor(s), agrees on behalf of both the minor(s) and myself to all of the terms and conditions in this Agreement.

In simple terms this is an agreement between you and Big Timber Waterslide simply stating that we have no liability insurance, and that in case of injury to you, you agree to furnish you own insurance and agree not to sue Big Timber Waterslide.

I HAVE READ THIS AGREEMENT AND UNDERSTAND IT. I UNDERSTAND THAT BY SIGNING THIS AGREEMENT I SURRENDER CERTAIN LEGAL RIGHTS. I DO SO FREELY AND VOLUNTARILY.
